1.   CONTEST PERIOD: 

The Ultimate Lotus F1 Team Experience Contest (the “Contest”) begins on May 6, 2013, at 12:00 p.m. Eastern Time (“ET”) and ends on July 28, 2013, at 11:59 p.m. ET (the “Contest Period”).

2.  ELIGIBILITY:

Contest is open to residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Unilever Canada Inc., The Sports Network Inc. (TSN), and Le Réseau des sports Inc. (RDS) (collectively, the “Sponsors”), their respective parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”).   By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”). In order to be eligible to win and/or participate in the Grand Prize, the potential Grand Prize winner and his/her travelling companion must satisfy the iRace 2013 terms and conditions, which are provided as Schedule A (the “iRace 2013 Terms and Conditions”), both at the time of accepting the Grand Prize and prior to participating in the Lotus F1 Team iRace Experience (see Rules 5 and 6 for details).

3.  HOW TO ENTER THE ONLINE CONTEST:

To enter the Contest, simply visit the web site located at www.TSN.ca/Race or www.RDS.ca/Course (collectively, the “Contest Website”), click on the “Register” or  “Enregistrez” button (as applicable), fully complete and submit your registration by following the instructions found on the web site, which will require you to: (i) provide your name, address, age, ten digit day and evening telephone numbers and e-mail address; (ii) create a username and password to allow you to subsequently log on to the applicable Contest Website; (ii) confirm that you have read and agree to be legally bound by the terms and conditions of these Rules; and (iii) confirm that you have read and acknowledge that in order to be eligible to win the Grand Prize you must comply with the iRace 2013 Terms and Conditions. By completing and submitting your registration during the Contest Period, you will receive one (1) regular entry into the Contest (each a “Regular Entry”). Limit of one (1) Regular Entry per person regardless of the email address, telephone numbers or addresses provided.  For greater certainty, you can only use one (1) email address to enter the Contest.

4.  HOW TO OBTAIN BONUS ENTRIES:

At the start of the Contest, there will be 80,000 unique PINs (each, a “PIN” and collectively, the “PINs”) available for distribution in accordance with the following procedures:

  1. WITH THE PURCHASE OF AN ELIGIBLE PRODUCT:Visit any participating retailer in Canada during the Contest Period and purchase a specially marked “Ultimate Lotus F1 Team Experience” Performance Pack which includes one (1) 381 mL CLEAR Men™ Scalp Therapy Clean & Refresh Anti-Dandruff Shampoo and one (1) 76g Degree® Men Adventure Anti-Perspirant stick, while supplies last (each, an “Eligible Product”).  There will be one (1) PIN included on each Eligible Product.
  2. NO PURCHASE NECESSARY: To obtain one (1) PIN, while supplies last, without having to purchase an Eligible Product purchase, print your first name, last name, telephone number, complete mailing address (including city, province, postal code), date of birth, phone number (with area code), email address and signature on a plain white piece of paper and mail it (in an envelope with sufficient postage) along with: (i) a self-addressed return envelope with sufficient postage; and, (ii) a 50 word or more unique and original essay on “Why you deserve to win the Ultimate Lotus F1 Team  Experience” (each, an “Essay”) to:

To be eligible, all mail-in no purchase necessary entry requests must: (i) be received separately in an envelope bearing sufficient postage (i.e. mass mail-in no purchase necessary entry requests in the same envelope will be void); and (ii) be post-marked on or before July 12, 2013, 11:59 p.m. ET allowing sufficient time for the Sponsors to respond by regular mail before the end of the Contest Period.  Upon receipt of your mail-in no purchase necessary entry request in compliance with these Rules, you will receive one (1)  PIN, while supplies last.  The Released Parties (defined below) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed mail-in no purchase necessary entry requests (all of which are void).

To submit your PIN, log on to Contest Website that you used to register for the Contest using the username and password provided at the time of registration and follow the on-screen instructions to submit your PIN during the Contest Period.  With each  PIN submitted in compliance with these Rules, the applicable entrant will be provided with five (5) bonus entries (each a “Bonus Entry”) (collectively, Regular Entries and Bonus Entries shall be referred to as “Entries” and each, an “Entry”).

All eligible Entries will be entered into the random prize draw (see Rule 6 for details).  Entries shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.   An entrant may be required to provide proof (in a form acceptable to the Sponsors – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Entry in question.

IMPORTANT NOTE: Each PIN is unique and can only be submitted one (1) time in the Contest.  Each PIN will automatically expire after its first use or at the end of the Contest Period (whichever occurs first).  There is a limit of one (1) PIN submission per entrant per day ( a “day” for the purposes of this Contest begins at 12:00 a.m. ET and ends at 11:59:59 p.m. ET).  Retain your original PINs as they may be required to be presented to the Sponsors as part of a verification process (see below).  The maximum total number of Bonus Entries that an entrant can obtain throughout this Contest Period is 420. 

If it is discovered by the Sponsors (using any evidence or other information made available to or otherwise discovered by the Sponsors) that any person has attempted to: (i) obtain more than one (1) regular Entry and/or the maximum amount of Bonus Entries for any period as provided in these Rules; (ii) use (or attempt to use) multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; (iii) falsely enter a PIN without obtaining a PIN in accordance with these Rules; (iv) re-enter a PIN any time after its first use; and/or (v) enter a PIN that has been falsified, manipulated or otherwise altered in any way; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsors.  Your Regular Entry may be rejected if (in the sole and absolute discretion of the Sponsors) your registration is not fully completed with all the required information, submitted and received during the Contest Period.  The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).     

All Entries and PINs are subject to verification at any time and for any reason.  The Sponsors reserve their right, in their sole and absolute discretion, to require proof of identity, eligibility and/or compliance with these Rules (in a form acceptable to the Sponsors – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or compliance of a an Entry or PIN entered (or purportedly entered) with these Rules; and/or (iii) for any other reason the Sponsors deem necessary, in their sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Further, the Sponsors reserve their right to request the original PIN for the purposes of verification.  Failure to provide such proof to the satisfaction of the Sponsors in a timely manner (including, if required, providing the original PIN) may result in disqualification in the sole and absolute discretion of the Sponsors.  The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

5. THE PRIZES AND APPROXIMATE RETAIL VALUES:

There will be one (1) grand prize (the “Grand Prize”) and five (5) secondary prizes (each a “Secondary Prize”) (collectively, the Grand Prize and the Secondary Prizes shall be referred to as the “Prizes”, and each a “Prize”) available to be won.

GRAND PRIZE: The Grand Prize consists of a trip for two (2) to participate in the Lotus F1 Team iRace Experience, which includes: round trip economy air fare for two (2) from a major Canadian airport closest to the Grand Prize winner's place of residence in Canada  (hereinafter referred to as the "Departure Point") to Marseille, France;  two (2) nights accommodation (based on one (1) room, double occupancy) at a hotel to be selected by the Sponsors at their sole discretion; formal training as to driving a Lotus F1 race car at the Circuit Paul Ricard (the  “Lotus F1 Team iRace Experience”); transportation between the racing track and the hotel; breakfast, lunch and dinner during the day of the Lotus F1 Team iRace Experience; and, $500 CAD in spending money.  In order to participate in the Lotus F1 Team iRace Experience, the Grand Prize winner and his/her travel companion must comply with the iRace 2013 Terms and Conditions, including, without limitation, the eligibility requirements provided therein. The approximate retail value of the Grand Prize is $19,000 CAD based on a Toronto, ON, Departure Point.

Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize: (i) the Grand Prize must be accepted as awarded and is not transferable or convertible to cash (no substitutions except at Sponsors’ option); (ii) all travel related to the Grand Prize must occur between September 9 – 12, 2013, unless Sponsors substitutes alternate dates (otherwise the Grand Prize will be forfeited in its entirety); (iii) the Grand Prize winner and his/her travel companion must: (a) travel on same itinerary; and (b) have all necessary documentation to permit travel to France and must have no legal impediment to enter France; (iv) if the Grand Prize winner (and/or his/her travel companion) does not, or is not eligible to, utilize any part(s) of the Grand Prize (including, without limitation, that he/she does not satisfy the iRace 2013 Terms and Conditions, as determined by the Sponsors and/or Lotus F1 Team Limited at their sole discretion), then any such part(s) not utilized will be forfeited in its entirety and the Sponsors shall be fully released from any liability and/or responsibility in this regard; (v) Sponsors reserve the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but solely at the Sponsors’ sole discretion, a cash award; (vi) all travel arrangements relating to the Grand Prize must be made through the Sponsors or their designated agents; (vii) by accepting the Grand Prize, the winner agrees to waive all recourse against the Releasees (defined below) if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part; (viii) all airline tickets are subject to availability at the time of booking; and (ix) neither Sponsors nor any of its prize suppliers will replace any lost or stolen tickets.

SECONDARY PRIZES: There will be five Secondary Prizes available to be won, each consisting of one (1) Official Lotus F1 Team t-shirt, hat and key chain. The characteristics and features of each of the Secondary Prize elements, unless otherwise explicitly stated herein, shall be selected by the Sponsors at their sole discretion. Each Secondary Prize has an approximate retail value of $100 CAD.

Without limiting the generality of the foregoing, each Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except for the spending money element of the Grand Prize and/or as may be specifically permitted by Sponsors in its sole and absolute discretion).  No substitutions except at Sponsors’ option.  Sponsors reserve the right, in their sole and absolute discretion, to substitute a Secondary Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsors’ sole and absolute discretion, a cash award. Each Prize will only be awarded to the person whose verifiable full name and valid email address appears on the registration associated with the applicable selected Entry. 

6. RANDOM PRIZE DRAW AND WINNER SELECTION:

On July 30, 2013 (the “Draw Date”) in Uxbridge, Ontario at 12 p.m. ET, six (6) eligible entrants will be selected by random draw from among all eligible Entries received during the Contest Period in accordance with these Rules.  The first selected entrant shall be deemed the potential Grand Prize winner and the following five selected entrants shall each be deemed a potential Secondary Prize winner.  The odds of winning a Prize will depend on the number of eligible Entries received during the Contest Period in accordance with these Rules. 

The Sponsors or their designated representative will make a minimum of two (2) attempts to contact the selected Grand Prize winner (using the information provided at the time of entry) within two (2) business days of the Draw Date.  If the selected Grand Prize winner cannot be contacted within two (2) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsors, be disqualified (and, if disqualified, will forfeit all rights to the Grand Prize) and the Sponsors reserve the right, in their sole and absolute discretion and time permitting, to nominate the first selected Secondary Prize winner as the alternate Grand Prize winner, in which case: (i) the alternate Grand Prize winner will forfeit all rights to a Secondary Prize; (ii) the foregoing provisions of this section shall apply to such alternate Grand Prize winner, with the necessary amendments; and (iii) the Sponsors reserve the right, in their sole and absolute discretion and time permitting, to randomly select an alternate Secondary Prize winner from among the remaining eligible Entries. 

The Sponsors or their designated representative will make a minimum of two (2) attempts to contact each selected Secondary Prize winner (using the information provided at the time of entry) within two (2) business days of the Sponsor declaring the confirmed Grand Prize winner (see below for details).  If a selected Secondary Prize winner cannot be contacted within two (2) business days of the of the Sponsor declaring the confirmed Grand Prize winner, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsors, be disqualified (and, if disqualified, will forfeit all rights to a Secondary Prize) and the Sponsors reserve the right, in their sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected Secondary Prize winner, with the necessary amendments). 

The Grand Prize winner and his/her travelling companion are subject to verification of compliance with the iRace 2013 Terms and Conditions, as determined by the Sponsors at their sole discretion, at any time prior to their departure for France.  The Sponsors reserve their right, in their sole and absolute discretion, to require proof of identity, eligibility and/or an attestation of compliance with the iRace 2013 Terms and Conditions (in a form acceptable to the Sponsors – including, without limitation, government issued driver’s licence) for the purposes of verifying an individual’s eligibility to participate in the Grand Prize and/or for any other reason the Sponsors deem necessary, in their sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the satisfaction of the Sponsors in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsors. 

Before being declared A CONFIRMED PRIZE winner, each selected Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within three (3) business days of notification the Sponsors’ declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable Prize (as awarded); (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors in any manner whatsoever, including print, broadcast or the internet; and, (v) with respect to the potential Grand Prize winner, confirms that he/she satisfies the iRace 2013 Terms and Conditions and releases the Released Parties from any and all liability in connection with any decision of the Sponsors and/or Lotus F1 Team Limited in relation to the Lotus F1 Team iRace Experience, including, but not limited to, any decision regarding the eligibility or ability of the Grand Prize winner to participate in the Lotus F1 Team iRace Experience.

Before being ABLE TO PARTICIPATE IN THE GRAND PRIZE, the Grand Prize winner’s travelling companion will be required to sign and return within three business days of notification the Sponsors’ declaration and release form, which (among other things): (i) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof; (ii) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsors in any manner whatsoever, including print, broadcast or the internet; and, (iii) confirms that he/she satisfies the iRace 2013 Terms and Conditions and releases the Released Parties from any and all liability in connection with any decision of the Sponsors and/or Lotus F1 Team Limited in relation to the Lotus F1 Team iRace Experience, including, but not limited to, any decision regarding the eligibility or ability of the travelling companion to participate in the Lotus F1 Team iRace Experience.

Once the Grand Prize winner and his/her travelling companion arrive in France, Lotus F1 Team Limited is solely responsible for administering all aspects of the Lotus F1 Team Experience, including, without limitation, all decisions relating to the Grand Prize winner’s and his/her travel companion’s compliance with the iRace 2013 Terms and Conditions. In the event that Lotus F1 Team Limited determines that the Grand Prize winner does not comply with the iRace 2013 Terms and Conditions, he/she will not be permitted to participate in the Lotus F1 Team iRace Experience, which shall be forfeited by the Grand Prize winner, and no substitution shall be provided in lieu thereof. In the event that Lotus F1 Team Limited determines that the Grand Prize winner’s travelling companion does not comply with the iRace 2013 Terms and Conditions, he/she will not be permitted to participate in the Lotus F1 Team iRace Experience, which shall be forfeited by the Grand Prize winner’s travelling companion, and no substitution shall be provided in lieu thereof.  The Sponsors are in no way responsible for any of Lotus F1 Team Limited’s decisions in this regard and shall be fully released from any liability and/or responsibility in this regard.

If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the applicable Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules or if it is determined that the selected Grand Prize winner does not or cannot satisfy the iRace 2013 Terms and Conditions (all as determined by the Sponsors and/or Lotus F1 Team Limited in their sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsors, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Sponsors reserve the right, in their sole and absolute discretion and time permitting, to: (i) with respect to a disqualified Secondary Prize winner, randomly select an alternate Secondary Prize winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant, with the necessary amendments); or, (ii) with respect to a Grand Prize winner that has been disqualified prior to his/her departure to France on the basis that he/she does not or cannot comply with the iRace 2013 Terms and Conditions (as determined by the Sponsors at their sole discretion), nominate the first selected Secondary Prize winner as the alternate Grand Prize winner, in which case such alternate Grand Prize winner will forfeit all rights to a Secondary Prize (which may, at the option of the Sponsors depending on the circumstances, be awarded to the disqualified potential Grand Prize winner) and the foregoing provisions of this section shall apply to such Prize winners, with the necessary amendments.

7.  GENERAL CONDITIONS:

If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be distributed or awarded according to these Rules, then, in addition to having the right to terminate the Contest immediately (subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec), the Sponsors reserve the right, in their sole and absolute discretion (subject only to the approval of the Régie in Quebec), to rescind invalid prize claims, conduct a random draw from amongst all eligible prize claimants to award the correct number of Prizes and/or .  In no event will the Sponsors be liable for more than the number of Prizes as stated in these Rules.  The total number of Prizes available to be won will decrease as Prizes are claimed and/or forfeited throughout the Contest Period.

If due to printing, production, online, internet, computer or other error of any kind, more PINs are printed than intended to be distributed according to these Rules and/or corrupted, dysfunctional or defective PINs are distributed, then, in addition to having the right to terminate the Contest immediately, subject only to the approval ofthe Régie in Quebec, the Sponsors reserve the right, in their sole and absolute discretion (subject only to the approval of the Régie in Quebec), to invalidate all PINs printed in excess of the number of PINs intended to be distributed according to these Rules and/or all PINs that are corrupted, dysfunctional or defective, and a PIN holder’s only remedy will be to receive another PIN, while supplies last.

All Entries become the property of the Sponsors.  This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsors with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries, PINs and/or entrants.  By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSORS AT ANY TIME. 

The Released Parties will not be liable for: (i) any failure of the Contest Website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or PIN to be received, captured,  recorded or operational for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

The Sponsors reserve the right, subject only to the approval of the Régie in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsors that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsors in their sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsors, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  Without limiting the generality of the forgoing, the Sponsors reserve the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

For Quebec residents:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsors, their agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy as set out in The Sports Network Inc.’s Privacy Policy at www.TSN.ca, Le Reseau des sports (RDS) Inc.’s Privacy Policy at www.RDS.ca and Unilever’s Privacy Policy: http://www.unilever.ca/resource/privacypolicy/index.aspx.

The Sponsors reserve the right, in their sole and absolute discretion (subject only to the approval of the Régie in Quebec), and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant, PIN or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsors, in their sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Entry Form, Contest Website, the French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

TERMS AND CONDITIONS


The following terms and conditions will apply without exception to every participant taking part in an iRace Day, whether as an individual or as part of a group booking. Lotus F1 Team may appoint third parties to assist with the organisation, logistics and running of all on-track activities during the day. Such third parties shall act as representatives of Lotus F1 Team and shall have authority, on behalf of Lotus F1 Team, to make all necessary decisions in operating and managing any and all aspects of your iRace Day.

1 PARTICIPATION
1.1 In order to participate in an iRace Day, you must ensure that:
  • you meet all of the Eligibility criteria (see paragraph 2);
  • full payment has been received by Lotus F1 Team (see paragraph 3);
  • you have signed and returned to Lotus F1 Team by post or email a completed medical questionnaire no later than 14 days prior to the iRace Day you are booked on. If you answer ‘yes’ to any question in the medical questionnaire, Lotus F1 Team may require you to obtain a note from a qualified medical practitioner validating your participation in the iRace Day (‘Doctor’s Certificate’); and
  • you have provided a copy of your driving licence and returned the signed ‘Release/Waiver and Assumption of Risk’ Form (‘Release Form’) by post or email to Lotus F1 Team no later than 14 days prior to the iRace Day that you are booked on.

1.2 Participation in some or all of the on-track activities will be refused to participants who have failed to submit a copy of their driving licence, a signed Release Form and a duly completed medical questionnaire as required in paragraph 1.1. No refund or compensation will be available.
2 ELIGIBILITY
2.1 In order to be eligible to participate in an iRace Day you:
  • must speak and understand English or French to a high level;
  • must be a minimum age of 22 and a maximum age of 65;
  • must hold a full current and valid driving licence;
  • must be between 1.55 metres and 1.90 metres in height;
  • cannot weigh more than 15 stone 10 lbs (100 kgs);
  • must not have blood pressure over 15/8;
  • must not have any previous heart conditions or history of epilepsy, head trauma with or without loss of consciousness, dizziness, slipped disk or hernia (unless you have submitted a Doctor’s Certificate);
  • must not be undergoing any medical treatment which may impair your judgement or reaction speed;
  • must have good eyesight.

2.2 Expectant mothers will be required to submit a Doctor’s Certificate.

2.3 If it becomes apparent at any point before or during the iRace Day that you do not meet any one of these criteria, Lotus F1 Team reserves the right to refuse you participation in all or part of the on-track activities scheduled for the day. No refund or compensation will be available.

2.4 In the event of a group booking by a company, the company shall be required to submit no later than 30 days prior to the selected iRace Day, a list of all proposed participants to Lotus F1 Team and shall ensure that such participants meet the Eligibility criteria set out above and comply with the requirements of clause 1.1. In the event that the company wishes to substitute a confirmed participant for another, it may do so up to 14 days prior to the scheduled iRace Day subject to informing Lotus F1 Team promptly of any such change and procuring the simultaneous submission of all relevant documentation from said new participant.
3 BOOKING AND PAYMENT
3.1 On receipt of a duly completed and signed Booking Form:
  • (a) you will be deemed to have agreed to and be bound by these Terms and Conditions;
  • (b) Lotus F1 Team will confirm whether there is availability for your chosen date. Where the date requested is oversubscribed, we will inform you and offer an alternative date;
  • (c) Lotus F1 Team will issue an invoice for the cost of each place booked on the iRace Day and, where relevant, accompanying guests as per details provided on the Booking Form. Invoices must be paid within 14 days of the date of the invoice. Failure to do so will result in the allocated place(s) being released for sale.

3.2 Places on an iRace Day will only be secured once payment of the full price has been received by Lotus F1 Team in cleared funds. Once payment is received the booking will be confirmed and any cancellation will be subject to paragraph 8 below.

3.3 Each iRace package includes accommodation in a hotel for one night, a cocktail reception and evening meal on the night of arrival, breakfast at the hotel on the morning of the iRace Day, lunch at the circuit and, subject to paragraph 4.1, all local transfers from airport-hotel-track and back to the airport. Under no circumstances shall Lotus F1 Team be liable for any personal expenses or ancillary costs incurred (e.g. mini-bar, use of hotel facilities etc.) or for any damage caused to the hotel by you or your guest during your stay. Any such expenses must be settled by you when checking-out. All return flights or other travel costs to and from France shall also be the responsibility of each participant or the company making a group booking (as appropriate).
4 TRAVEL TO FRANCE
4.1 As stated in paragraph 3.3, all travel arrangements and costs (including visas if required) shall be the responsibility of each participant and/or, in the event of a group booking, the company making the booking. Participants are requested to arrive at Marseille airport the day before the iRace Day they are booked on between 4pm and 6pm to benefit from the local transfer services offered by Lotus F1 Team as part of the package. Participants with flights scheduled for earlier or later arrivals shall make their own way at their own cost to the hotel.

4.2 No refund and/or compensation will be made in respect of any participant’s inability to attend any part or all of the iRace Day booked due to transport/travel issues. Lotus F1 Team may, at its absolute discretion and at all times subject to availability, offer participation in another iRace Day taking place in the same week. Should the participant accept such alternative, all additional travel, subsistence and accommodation costs shall be solely borne by such participant.
5 COMPLIANCE / HEALTH AND SAFETY
5.1 You agree and acknowledge that all on-track elements of the iRace Day shall be high risk and inherently dangerous.

5.2 In order to ensure your safety and well-being at all times, you must adhere to all health and safety instructions and/or regulations at the circuit, attend all briefings and comply with all instructions given by driving instructors and briefing staff engaged by Lotus F1 Team.

5.3 For safety reasons, Lotus F1 Team will provide all protective clothing and equipment required for the iRace Day. You must wear this at all times as required by Lotus F1 Team. For the avoidance of doubt, you will not be permitted to wear any protective clothing or use any equipment other than that provided by Lotus F1 Team.

5.4 If at any time Lotus F1 Team deems that you are: (a) unable to adhere to or have not adhered to instructions or health and safety rules; (b) unable to remain in full control of your car; (c) behaving in an inappropriate or unacceptable manner; (d) under the influence of alcohol and/or drugs; or (e) if you make contact with another car or are involved in an accident, Lotus F1 Team reserves the right to curtail the relevant on-track session you are taking part in and/or refuse, for safety reasons, to allow you to drive the high speed F1 single-seater.
6 PASSES AND ACCREDITATION
Lotus F1 Team will provide all passes and accreditation required to give you access to the circuit. You must comply with the terms and conditions of each and every pass and accreditation issued, failing which you may be removed from the circuit. No refund and/or compensation will be available should you not be able to participate in the scheduled iRace Day activities as a result.
7 GUESTS
7.1 Guests attend the iRace Day as spectators at the circuit and do so entirely at their own risk.

7.2 All accompanying guests will have access to the circuit but will not be allowed to participate in any on-track and briefing activities during the iRace Day.

7.3 You must ensure that your guests comply with all health and safety requirements at the circuit, the terms and conditions of the accreditation supplied to them and any other instructions given to them by Lotus F1 Team.

7.4 The guest package includes an invitation to the cocktail reception and evening meal on the night of arrival, breakfast at the hotel on the morning of the iRace Day, lunch at the circuit and, subject to paragraph 4.1, all local transfers from airport-hotel-track and back to the airport.
8 CANCELLATION
8.1 Lotus F1 Team reserves the right to cancel any iRace Day in the event that there are insufficient participants, in which event notice of not less than 14 days will be given and you will be given priority booking for a future event. If an alternative date is unsuitable or unwanted, a full refund will be offered to those who have a confirmed booking.

8.2 In the event that you cancel a booking, cancellation charges shall apply. Lotus F1 Team shall be entitled to retain the following amounts from the booking fee paid by you based on the date Lotus F1 Team receives written notification of your cancellation:
Less than 14 days prior to
iRace Day you are booked on
100% booking fee (i.e. no refund)
More than 14 days prior to
iRace Day you are booked on
40% booking fee (i.e. 60% refund)
9 FORCE MAJEURE
9.1 Lotus F1 Team will not be liable for any failure or delay in performance of an iRace Day arising from or attributable to acts, events, omissions or accidents beyond its reasonable control. This includes but is not limited to acts of god, fire, explosion, natural disaster, ash cloud, flood, war, terrorist attack, threats of terrorism, any government act, interruption or failure in the power supply or labour dispute.

9.2 Should any of the above occur Lotus F1 Team reserves the right to cancel any iRace Day, in which event you will be given priority booking for a future event. If an alternative date is unsuitable or unwanted, a full refund will be offered in respect of such cancellation.
10 CHANGES TO THE iRACE DAY PROGRAMME
Whilst Lotus F1 Team takes every care to ensure that the iRace Day will follow the scheduled programme as notified to you, the nature of the programme means that it may be subject to change. Lotus F1 Team reserves the right to make amendments to any part of the schedule and/or services provided as considered reasonably necessary whether for safety reasons or otherwise. In particular, Lotus F1 Team reserves the right to make changes to the iRace Day running schedule if weather conditions affect the safe conduct of any of the scheduled on-track activities.
11 VIDEO AND PHOTOGRAPHY
11.1 You acknowledge and accept that you may be filmed or photographed at the circuit. Videos or photos of you may be used by Lotus F1 Team or the owner of the circuit for commercial and promotional purposes and you hereby consent to be filmed and/or photographed for these purposes without entitlement to any payment or other form of compensation.

11.2 Lotus F1 Team will have an official photographer on site throughout the iRace Day. Any such photos taken will be made available for you to download free of charge for a limited period of time and for your private use only.

11.3 You and your guests are allowed to film, photograph and/or record your participation in the iRace Day on the condition that any such images or recordings are used only for private and non-commercial purposes.
12 LIABILITY
12.1 Lotus F1 Team (including third parties appointed by Lotus F1 Team to assist in the running and organisation of the iRace Day and/or any professional driver of the Formula 1 two-seater car) will not be liable for any personal injury, death or other loss or damage caused to or suffered by you or your property save to the extent required by law.

12.2 Save where liability cannot by restricted or excluded by law:
  • (a) the maximum aggregate liability of Lotus F1 Team, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will in no circumstances exceed an amount equivalent to the booking fee per participant and per claim; and
  • (b) Lotus F1 Team shall have no liability to you for loss of business opportunity, use, profit, anticipated profit, contracts, revenues, goodwill or anticipated savings, consequential, special or indirect loss or damage.

12.3 You shall be liable for any damage caused to any persons, property, hotel accommodation, cars or equipment as a result of your reckless or negligent behaviour or that of your guests.
13 INSURANCE
13.1 Lotus F1 Team maintains third party liability insurance for the iRace Programme under which all participants are covered. Please be aware that Lotus F1 Team does NOT maintain any insurance policies that cover injury or loss sustained by you as a result of the actions of another participant.

13.2 All cars used in the iRace Day are valuable high performance vehicles. Accordingly, each participant (or in the case of a group booking, the company, on behalf of its participants) shall be liable for any damage caused to a car (or any ancillary equipment) as a result of his/her negligence, recklessness or failure to comply with instructions and briefings received on the day. In such circumstances, Lotus F1 Team shall be entitled to invoice the participant and/or the company making the booking for all necessary repair costs.

13.3 Each participant shall be responsible for taking out his/her own personal travel insurance.
14 DATA
14.1 Any personal information that you provide to Lotus F1 Team will only be used and recorded in accordance with the Data Protection Act 1998 (as amended). Lotus F1 Team will use your personal information to fulfil a booking for an iRace Day.

14.2 Lotus F1 Team and/or its commercial partners may also use your personal information in order to contact you about news and offers that may be of interest to you. If you decide at any point that you no longer wish to receive messages of this nature, you may click to unsubscribe at the bottom of any emails or communications you receive.

14.3 All medical information will be kept confidential and only used by Lotus F1 Team as evidence provided by you of your ability to take part in an iRace Day.
15 GENERAL
15.1 The Booking Form, these Terms and Conditions and the Release Form represent the entire agreement between Lotus F1 Team and you with respect to the iRace Day.

15.2 Any part of these Terms and Conditions which is found to be invalid or unenforceable shall be deemed replaced with such provision which is as near to the intent of the original provision as possible but which is not invalid or unenforceable.

15.3 Any variation to these Terms and Conditions shall only be valid if agreed by an authorised representative of Lotus F1 Team in writing.

15.4 These Terms and Conditions shall be governed by English law and the parties agree to submit any dispute to arise out of them or the Release Form to the exclusive jurisdiction of the English courts.
